These Terms and Conditions (“Terms”) govern your use of our website and services for purchasing custom-made garments. By accessing or using our website and/or services, you agree to comply with and be bound by these Terms.
1. ORDER AND CUSTOMISATION
1.1 ORDER PROCESS
By placing an order, you agree to provide accurate information, body measurements, and customisation details. Our Digital Tailor will generate your custom measurement profile based on your inputs. You can then customise your garments and proceed to checkout.
1.2 CUSTOMISATION OPTIONS
You can personalise various aspects of your garments, including buttons, collars, cuffs, and monograms. Please ensure all customisation details are correct before finalising your order.
1.3 ORDER MODIFICATIONS
You can modify or cancel your order within 48 hours of placing it. After this period, modifications may not be possible. For adjustments, please contact our customer support team via the CONTACT US portal on our website.
1.4 ORDER ACCEPTANCE AND LIMITATIONS
We reserve the right, without prior notice, to limit the quantity of products or services ordered and/or not to accept your order if we are unable to obtain authorisation for payment, if shipping restrictions apply, if the ordered item is no longer available, if the order fails our security checks, or if it does not meet our quality control standards and is withdrawn. Additionally, we may decline to process or accept a transaction for any reason or refuse service to anyone at any time at our discretion. We will not be liable to you or any third party for withdrawing any product from our website, removing or editing content on the website; declining to process a transaction, or suspending any transaction after processing has commenced.
2. PRICING AND PAYMENT
2.1 PRICING
All prices are listed in Australian Dollars (AUD) and are subject to change without notice.
2.2 PAYMENT METHODS
We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, and Afterpay. All transactions are securely processed. You must be fully entitled to use the payment method or account used for the purchase. The payment method or account must have sufficient funds or credit facilities to cover the purchase. We reserve the right to obtain validation of your payment details before providing you with the product and carry out any necessary security checks.
2.3 ADDITIONAL CHARGES
Shipping fees and any applicable taxes or duties are not included in the product price and will be added at checkout.
3. SHIPPING AND DELIVERY
3.1 DELIVERY TIMEFRAMES
- WITHIN AUSTRALIA: Orders typically arrive within 3-4 weeks from the order date.
- INTERNATIONAL: Delivery times vary by destination, usually within 4-6 weeks.
3.2 SHIPPING FEES
- DOMESTIC SHIPPING: $19.95
- INTERNATIONAL: $25-$80, based on order weight.
3.3 DISPATCH DELAYS
All orders are subject to security checks. Please note, during peak periods such as sale events and holidays, processing and production times may be extended due to increased order volumes. Furthermore, shipping times may also be affected by COVID-19 restrictions or delays from our delivery partners. Should there be any extension in processing, production, or shipping timeframes, we will promptly notify customers via email, update our website, or communicate through marketing emails.
3.4 SPLIT ORDERS
If your order contains multiple items, they may be dispatched separately at no additional shipping cost. You will receive a new tracking number for each shipment.
3.5 TAXES AND DUTIES
International orders may incur duties and taxes upon arrival in their destination country. These charges are the responsibility of the customer.
4. PRODUCTS, CONTENT AND SPECIFICATIONS
4.1 CONTENT DESCRIPTIONS AND UPDATES
We reserve the right to modify all features, content, specifications, products, and pricing depicted or described on our website at any time without prior notice. While we make every effort to accurately display product attributes, including colours, please note that the actual colour you see may vary depending on your computer system. We cannot guarantee that your computer or device will accurately display these colours.
5. RETURNS, ALTERATIONS, REMAKES AND REFUNDS
5.1 CONSUMER GUARANTEES
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a repair, replacement or refund for a major failure and compensation for any reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality.
5.2 RETURNS ON CUSTOM-MADE GARMENTS
We do not accept change of mind returns on custom-made garments. However, we will address any fit or quality issues to ensure your satisfaction.
5.3 FIT GUARANTEE
Your first purchase of each garment type is covered by our Fit Guarantee. If the initial order doesn’t fit perfectly, we will cover the cost of alterations or remake it for free. If the issue can be corrected with an alteration, we will prioritise that solution. If alterations cannot resolve the fit issue, we will proceed with a remake. Subsequent orders are eligible for alterations reimbursement. Reimbursement amount is dependent on the garment type.
5.4 REMAKES
If your garment cannot be altered, we will work with you to adjust your measurements and remake the item. To initiate a remake, fill out the Remake Request Form and submit via the CONTACT US portal within 30 days of delivery. The original garment must be returned in its original condition, unworn, unwashed, unused, unaltered, and with all tags or accompanying packaging still attached. It is the responsibility of the customer to ensure that the original item is returned. Maison Cloth are not liable should the returned item be lost in transit. If the original item is not returned, Maison Cloth hold the right to refuse a remake. Remakes are subject to stock and fabric availability. If the product or fabric is no longer available, you may select an alternative of equal or lesser value. Additional charges may apply for items or fabrics of higher value. Remakes cannot be initiated based on changes in customisation.
5.5 ALTERATIONS
Take your garments to a local tailor and request an itemised receipt. Complete the Alterations Reimbursement Form within 30 days of delivery. Our team will review your request, and if approved, reimbursement will be processed back to your original payment method. Please note, alterations reimbursement is not applicable if the garment is being remade.
5.6 INCORRECT, FAULTY, OR DAMAGED ITEMS
If you receive an incorrect, faulty, or damaged item, CONTACT US immediately with your order number, a brief description of the issue, and images if necessary. We will advise on the next steps for a replacement, repair, or refund.
Faulty items must be assessed in person. If the item has a major problem as defined by Australian Consumer Law, you are entitled to choose a refund, repair, or replacement.
6. CUSTOMER OBLIGATIONS
6.1 ACCURACY OF INFORMATION
You are responsible for providing accurate body measurements, descriptions, and customisation details. Incorrect information may result in fit, quality, or style issues.
7. INTELLECTUAL PROPERTY
7.1 OWNERSHIP
All content, designs, algorithms, and software displayed on or accessible from this website are the exclusive property of Maison Cloth or used under license and are protected by copyright, trademark, and other applicable laws. These materials may only be used as permitted in these Terms or with prior written consent from Maison Cloth. Modification, re-production, public display, performance, distribution, or any other use of these materials for public or commercial purposes without Maison Cloth’s express permission is prohibited. Unauthorised use may result in violations of copyright, trademark, privacy, publicity, and other legal statutes.

9. USER CONDUCT
9.1 PROHIBITED MATERIAL
You are prohibited from posting, transmitting, or otherwise making available through our website and/or affiliated pages any unlawful, threatening, defamatory, libellous, obscene, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. You are also prohibited from uploading or transmitting any virus, worm, time bomb, Trojan horse, or other harmful or disruptive component, or any automated device, spider, crawler, bot, or routine that can collect unauthorised information or interfere with the operation of the website or any user’s enjoyment of the website. We reserve the right to monitor or review content posted on our website or affiliated pages and to remove any content that violates these Terms or is otherwise objectionable. In no event shall Maison Cloth, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors, be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation, loss of profit, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of our website or any products purchased from us, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, Maison Cloth’s total liability to you for all claims related to the website or products shall not exceed the amount paid by you to Maison Cloth for the specific product or service giving rise to the claim. The limitations and exclusions of liability set forth in this section apply notwithstanding any failure of essential purpose of any limited remedy. These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes, controversies, proceedings, or claims arising out of or relating to these Terms will be resolved in accordance with the laws of New South Wales, Australia. The validity of this governing law clause is not contested. These Terms shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.
13. MODIFICATIONS TO THESE TERMS AND CONDITIONS

Maison Industries Pty Ltd reserves the right to review and modify any of the Terms at its sole discretion. When Terms are updated, we will make reasonable efforts to notify you of the changes. Any modifications to the Terms take immediate effect from the date of their publication.
14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Maison Cloth, its officers, directors, employees, agents, affiliates, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorney’s fees, arising out of or relating to your use or misuse of our website or services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity. This indemnification obligation will survive the termination of these Terms and Conditions and your use of our website and services.
15. TERMINATION
15.1 TERMINATION OF CONTRACT
Your account or use of this website can be terminated by either you or Maison Cloth at any time. Maison Cloth reserves the right to terminate your access to the website and the services provided therein, without prior notice, for any reason, including but not limited to, if we believe that you have violated these Terms, any applicable law, or have engaged in conduct that we deem inappropriate or unacceptable. Upon termination, all provisions of these Terms and Conditions by which their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. If your account is terminated, you are still personally liable for any orders that you place or outstanding payments that you incur prior to termination.
